ParPal Golf App – Terms of Use

  1. Acceptance of Terms
    • By downloading, installing, accessing, or using the ParPal Golf mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
  2. Description of Service
    • ParPal Golf is a mobile application that uses artificial intelligence to provide golf-related services, which may include but are not limited to:
    • Golf swing analysis and improvement recommendations
    • Course management and strategy suggestions
    • Performance tracking and statistics
    • AI-powered coaching and tips
    • Social features for connecting with other golfers
  3. User Accounts
    • Account Creation
    • You must create an account to access certain features of the App.
    • You must provide accurate, current, and complete information.
    • You are responsible for maintaining the security of your account credentials.
    • Age Requirement. You must be at least 13 years old to create an account or use the App. During account creation, you must confirm that you are 13 or older. If you do not confirm, you will not be permitted to create an account. We do not knowingly collect personal information from children under 13. If we learn that a user under 13 has created an account, we will promptly terminate the account and delete any associated data.
    • Minors Ages 13–17. If you are between the ages of 13 and 17, you represent that you have the consent of a parent or legal guardian to use the App, where required by the laws of your state or jurisdiction. In certain states (including Texas, Utah, and Louisiana), parental approval may be required for minors to use the App or make purchases.
    • Account Responsibility
    • You are solely responsible for all activities that occur under your account.
    • You must immediately notify us of any unauthorized use of your account.
    • We reserve the right to suspend or terminate accounts that violate these Terms.
  4. User Content and Data
    • Content You Provide
    • You retain ownership of content you upload (e.g., videos, photos, personal data).
    • By uploading content, you grant EagleAI LLC a non-exclusive, worldwide, royalty-free, limited license to use, reproduce, process, and analyze your content solely for the purpose of operating, providing, and improving the App and its services. This license does not include the right to sell your content to third parties. This license terminates when you delete your account, except that anonymized and aggregated data derived from your content may be retained.
    • You represent that you have the right to share any content you upload.
    • Golf Performance and Voice Data
    • The App may collect and analyze data about your golf performance and voice interactions.
    • This data is used to provide personalized recommendations and improve our AI systems.
    • By using the App, you explicitly consent to this data collection, processing, and analysis.
    • Biometric Data Notice (Illinois BIPA). The App's AI caddie feature collects voice recordings that may constitute biometric identifiers under the Illinois Biometric Information Privacy Act ("BIPA"). By using the voice features of the App, you acknowledge and consent to the collection, use, and storage of your voiceprint data. Voice audio is processed in real-time and is not permanently stored.     • You can request deletion of your data at any time through the App settings.
  5. AI Analysis and Recommendations
    • Nature of AI Services
    • Our AI analysis is provided for informational and educational purposes only.
    • Recommendations are based on available data and may not be suitable for all users.
    • Results and improvements are not guaranteed.
    • AI-generated outputs may contain errors, inaccuracies, or hallucinations. You should independently verify any AI recommendation before relying on it.
    • AI models powering the App may be updated periodically. As a result, outputs and recommendations may change over time, even for the same input data.
    • Limitations
    • AI suggestions are not a substitute for professional coaching.
    • We recommend consulting a PGA-certified instructor for personalized coaching.
    • Use recommendations at your own discretion and risk.
  6. Acceptable Use
    • Permitted Uses
    • Use the App for personal, non-commercial golf improvement.
    • Share content and interact respectfully with others.
    • Provide feedback to improve the App.
    • Prohibited Uses
    • You may not:
    • Use the App for unlawful purposes or in violation of these Terms.
    • Upload offensive or infringing content.
    • Reverse engineer, hack, or compromise App security.
    • Spam, harass, or abuse other users.
    • Share your credentials or use automation to access the App.
  7. Privacy and Data Protection
    • Your privacy is important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to these practices.
  8. Intellectual Property
    • Our Rights
    • The App and its content are protected by copyright and trademark laws.
    • We own all rights to the App's software, AI models, and branding.
    • Your Rights
    • You retain rights to your uploaded content.
    • You may not use our IP except as permitted in these Terms.
  9. Subscription and Payment
    • Premium Features
    • Some features may require a paid subscription.
    • Fees are billed in advance and are non-refundable, unless required by law.
    • Subscriptions renew automatically unless canceled in advance.
    • Free Trials
    • Free trials may be offered and will auto-convert to a paid plan unless canceled.
    • Cancel before the trial ends to avoid charges.
  10. Disclaimers and Limitations
    • Service Availability
    • The App is provided "as is" and "as available."
    • We do not guarantee uninterrupted or error-free access.
    • Features may be changed or removed at any time.
    • Limitation of Liability
    • To the maximum extent permitted by law:
    • We are not liable for indirect or consequential damages.
    • Our total liability is limited to what you've paid in the past 12 months.
    • We are not responsible for golf-related injuries or equipment damage.
    • Assumption of Risk
    • Golf involves physical activity and inherent risks.
    • You assume all risks from using the App and following AI suggestions.
    • Consult a medical professional before starting any physical or fitness activity.
  11. Indemnification
    • You agree to indemnify and hold harmless EagleAI LLC, its officers, employees, and affiliates from any claims or liabilities arising from:
    • Your use of the App
    • Your violation of these Terms
    • Your violation of third-party rights
    • Your uploaded or shared content
  12. Termination
    • By You
    • You may terminate your account at any time via the App.
    • No refunds are provided for early termination.
    • By Us
    • We may terminate your account for:
    • Violating these Terms
    • Fraud, abuse, or harassment
    • Posing a security threat to the App or its users
  13. Beta Version Acknowledgment
    • Certain features of the App may be designated as beta or early access.
    • You understand that beta features may be unstable, incomplete, or subject to change.
    • Features may be added or removed without notice, and data loss may occur.
    • Your feedback may be used to improve the product.
  14. Third-Party Services
    • The App integrates third-party technologies and platforms to provide its services, including but not limited to:
    • AI & Machine Learning: OpenAI (voice transcription via Whisper, natural language processing via GPT), Anthropic (course strategy and analysis via Claude), ElevenLabs (text-to-speech), and Pinecone (shot history and recommendations).
    • Infrastructure & Payments: Firebase/Google Cloud (cloud infrastructure and authentication) and Stripe (payment processing).
    • By using the App, you acknowledge that these services may have their own terms and privacy policies, and that we are not responsible for third-party service reliability or data handling.
    • We may add, remove, or change third-party service providers from time to time. Material changes will be reflected in our Privacy Policy.
  15. Updates and Modifications
    • App Updates
    • Updates may be required to continue using the App.
    • Terms Updates
    • We may revise these Terms.
    • Material changes will be communicated via the App or email.
    • Continued use constitutes acceptance of the revised Terms.
  16. Governing Law and Disputes
    • Governing Law
    • These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws principles.
    • Dispute Resolution
    • Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect.
    • Arbitration shall take place in Cook County, Illinois, or at another mutually agreed location. You may also elect to participate by phone or video conference.
    • Fees. If your claim is for $10,000 or less, EagleAI LLC will pay all arbitration filing, administration, and arbitrator fees. For claims above $10,000, fees will be allocated according to the AAA Consumer Arbitration Rules.
    • Opt-Out. You may opt out of this arbitration provision by sending written notice to support@parpalgolf.com within 30 days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.
    • Class Action Waiver. You and EagleAI LLC agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If a court or arbitrator determines that this class action waiver is unenforceable, the arbitration agreement shall be null and void as to that claim.
    • Small claims court disputes are excluded from arbitration.
  17. Accessibility
    • EagleAI LLC is committed to making the ParPal Golf App accessible to all users. If you experience accessibility barriers, please contact us at support@parpalgolf.com so we can work to address your concerns.
  18. Miscellaneous
    • Entire Agreement: These Terms, together with the Privacy Policy, are the full agreement between you and EagleAI LLC regarding the App.
    • Severability: If one provision is invalid, the rest remain in effect.
    • Waiver: Failure to enforce a term is not a waiver of that term.
    • Assignment: You may not transfer these Terms without written consent.
